Terms & Conditions

The following Terms and Conditions apply to all products and services provided by Rightlook Creative. All work is carried out by Rightlook Creative on the understanding that the client has agreed to the following terms and conditions. These Terms and Conditions supersede any previous Terms and Conditions distributed in any from. Rightlook Creative reserves the right to change any rates and any of the Terms and Conditions at any time and without prior notice.
The placement of an order for design, print and/or any other services offered by Rightlook Creative and validated by the client’s signature on quotation form, constitutes acceptance of the quotation and agreement to comply fully with all the Terms and Conditions and forms a Contract for Business between the signatory and Rightlook Creative Client is 100% responsible for the accuracy of layouts. Please proofread all layouts carefully. Rightlook Creative will not be held responsible for proofing errors once the file(s) are sent to print.

Copyright and Trademarks:

The client declares that they hold the appropriate copyright and/or trademark permissions for any text, images and/or data supplied to Rightlook Creative. The ownership of such materials will remain with the client, or rightful copyright or trademark owner. By supplying images, text, or any other data to Rightlook Creative, the client grants Rightlook Creative permission to use this material freely in the pursuit of the design. The client agrees to indemnify and hold Rightlook Creative, and its employees and independent contractors harmless from any claim, demand, damages, liability, costs and expenses including but not limited to attorneys' fees made by any third party due to or arising out of any claims resulting from the client in not having obtained all the required copyright, trademark, intellectual property, proprietary or privacy right of any person or entity.
Rightlook Creative does not accept artwork deemed offensive. Images or words that are ethnically, religiously, racially or sexually offensive will not be accepted.

Ownership:

Some copyright is retained by Rightlook Creative on all design work including words, pictures, ideas, visuals and illustration unless specifically released in writing and after all costs have been settled. Any artwork, images, or text supplied and/or designed by Rightlook Creative on behalf of the client, will remain the property of Rightlook Creative and/or it's suppliers. The client may request in writing from Rightlook Creative, the necessary permission to use materials (for which Rightlook Creative holds the copyright) in forms other than for which it was originally supplied, and Rightlook Creative may, at its discretion, grant this. Such permission must be obtained in writing before any of the artwork, images, text, or other data can be used.
Rightlook Creative reserves the right to use clients’ marketing designs and work for any and all promotional purposes. The promotional distribution may include but not limited to Rightlook Creative’s collateral, marketing materials, websites, catalogs, emails and any other marketing in any medium that Rightlook Creative may employ as necessary. Clients can withdraw their marketing designs and work from being used as samples by sending a written request to Rightlook Creative.

Privacy:

All information provided to Rightlook Creative is kept confidential. Rightlook Creative does not sell, rent or exchange clients’ information.

Payment Terms:

A 50% deposit of the full price is due before design work will begin. The balance will be due upon the initial proof approval. Rightlook Creative accepts cash, check, money order, wire transfer, VISA, MasterCard, American Express and Discover. All returned checks will be charged a $25 fee.
Orders exceeding $1000 or greater may require an authorization form and copy of credit card and driver’s license or a valid photo identification.

Sales Tax Policy:

Rightlook Creative is required to collect sales tax on purchases shipped within California. If client’s order qualifies for sales tax exemption, a valid California Resale Certificate must be provide at the time of order via email or fax.

Delivery:

Client’s order may be delayed if the customer has failed to provide Rightlook Creative all necessary materials. Quoted delivery dates are only estimated dates.
Orders may arrive late due to unforeseen delays in delivery service, natural disaster, bad weather, international customs issues or any other circumstances out of Rightlook Creative’s direct control. Client is responsible for all customs, duties or fees related to an international shipment. Rightlook Creative is not liable for damage caused by any shipping service carrier.

Order Cancellation/Refunds:

Rightlook Creative reserves the right to refuse any order.
All sales are final, unless otherwise noted. No refunds will be given once design or printing begins on your order.
Client must notify Rightlook Creative within 3 business days of order acceptance to report any defects covered in the ordered product. 

Alterations:

The free revisions offered in packages only include minor tweaks, adjustments and color changes.
The client agrees that changes required over and above the estimated work or required to be carried out after acceptance of the draft design will be liable to a separate charge.
The client also agrees that Rightlook Creative holds no responsibility for any amendments made by any third party, before or after a design is published.

Warranty:

Rightlook Creative hereby represents, warrants and agrees to client that it will provide the services identified in the agreement in a professional manner and in accordance with all reasonable professional standards for such services. Rightlook Creative further represents, warrants and agrees to client that the final deliverables shall be the original work of Rightlook Creative and/or its independent contractors, except for third party materials and client content.
In the event that the final deliverables include the work of independent contractors commissioned for the project by Rightlook Creative, Rightlook Creative shall have secure agreements from such contractors granting all necessary rights, title, and interest in and to the final deliverables sufficient for Rightlook Creative to grant the intellectual property rights provided in this agreement. In the event the client modifies or otherwise uses the deliverables outside of the scope or for any purpose not identified in the agreement or contrary to the terms and conditions noted here, all representations and warranties of Rightlook Creative shall be void.

Data Backup Liability Disclaimer:

Rightlook Creative is not held liable for the backup of marketing graphics. It is the client’s responsibility to save and backup their graphic files supplied to them on CD-ROM by Rightlook Creative In the event of malicious activity such as a virus or worm, hardware failure, fire, natural disaster, terrorist event, time of ware or simply to make room for other data, Rightlook Creative cannot ensure preservation of any data. Any requests for CD to be mailed again will be subject to a $25 shipping and handling fee.

Pre-Designed Templates:

Only custom finalized graphic files will be supplied to the client on CD-ROM. Please note that pre-designed templates/graphics from Rightlook Creative are not supplied to the client. Rightlook Creative retains copyright on any pre-designed templates that may be used for the client’s work. The templates used in clients’ work cannot be reproduced, copied or sold.
